Letter to the editor

Thomas Jefferson said, “The two enemies of the people are criminals and government, so let us tie the second down with the chains of the Constitution so the second will not become the legalized version of the first.”

Unfortunately, the Federal Government is now merged with the criminals! (See the admissions of conspiracy in “Time Magazine,” “The Secret History of the Shadow Campaign That Saved the 2020 Election”).

So we must now attempt to use some of the ‘chains’ to prevent tyranny. There have been and will be many attempts to ignore the constitution but fortunately a few ‘we the people’ are waking up to this attack.

What does the constitution say: From research on line I copied the following:

2nd Amendment to the Constitution: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

10th Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Article I, Section 9, Clause 3: “No Bill of Attainder or ex post facto Law shall be passed.”

“Both federal and state governments are prohibited from enacting ex post facto laws, and the Court applies the same analysis whether the law in question is a federal or a state enactment.”

What is Ex Post Facto Law?

“An Ex Post Facto law is a retroactive law that ultimately changes the legal status or consequences of actions committed or relationships that may have existed prior to the formal enactment of the law.”

Now suppose we have a firearm with a 20 round clip and congress passes legislation making it a criminal offense to own such a gun. Since it was legal before the law, the law is patently unconstitutional since it is an ‘Ex Post Facto’ law. Of course it is also a violation of the 2nd amendment.

It is quite obvious that if we have the firearm, it is much easier to prevent infringement of constitutional rights than if we have no means to resist. And if we have a “well regulated militia” through our local law enforcement or some other organization to peacefully and patriotically enforce the constitution, we may preserve the constitution for future generations.

Sincerely, Richard O. Harkins
